TAILORED JEWEL TERMS AND CONDITIONS

1. INTRODUCTION

These Terms and Conditions (“Terms”) apply to the Tailored Jewel website (www.tailoredjewel.com for Malaysia and www.tailoredjewel.com.sg for Singapore), mobile websites, and mobile applications operated by Tailored Jewel Sdn Bhd (Malaysia) and Tailored Jewel (SG) Pte Ltd (Singapore). The services and products offered on this Site are provided by Tailored Jewel Sdn Bhd, a Malaysian company (1100694-X), and Tailored Jewel (SG) Pte Ltd, a Singapore company (202221290M), collectively referred to as “Tailored Jewel.”

By accessing or using this Site, you confirm that you understand and agree to these Terms. If you do not agree to these Terms and Conditions, please discontinue using our website. We reserve the right to update these Terms at any time. Any changes will be posted on the Site, and your continued use constitutes acceptance of those changes.


2. USE OF THE SITE

Tailored Jewel grants you a non-transferable, revocable license to access and use the Site solely for personal shopping or non-commercial purposes. Unauthorized commercial use is prohibited unless explicitly authorized by Tailored Jewel. Any violation of these Terms may result in immediate revocation of your access to the Site.

The Site may provide certain services or features that require registration or subscription. You agree to provide accurate and up-to-date information during registration and to maintain the security of your account. You are solely responsible for maintaining the confidentiality of your password and account and for all activities that occur under your account.


3. WARRANTY AND GUARANTEES

  1. 10-Year Warranty on Gold and Platinum Rings:

    • Tailored Jewel offers a 10-year warranty on gold and platinum rings from the date of purchase. This warranty covers defects in materials and craftsmanship, excluding damage caused by misuse, alterations, or third-party repairs.

    • Tailored Jewel is not liable for defects or damages arising from wear and tear, improper handling, or alterations made to the product without prior consent.

  2. TJ Flexi – Change Design Policy:

    • The TJ Flexi policy allows customers to modify the design of their wedding ring within 60 days of purchase, subject to a design modification fee.

    • The design modification fee will be provided in the applicable local currency and is determined at the time of the modification request.

    • The ring must be in perfect condition and free from any damage or alterations. This fee covers reasonable adjustments (e.g., resizing or altering the ring’s design). Exclusions apply for changes that are extensive or require complete redesigns.

  3. TJ Assurance – 14-Day Money-Back Guarantee for Premium Diamonds:

    • TJ Assurance offers a 14-day money-back guarantee on diamonds under the TJ Premium Pick selection (diamonds with D-F color and VS1+ clarity).

    • This guarantee applies only to diamonds and excludes shipping and handling fees, as well as customizations or personalizations made after the purchase.

    • Returns will be processed upon inspection, and the diamond will be refunded only if it meets the quality and condition requirements outlined by Tailored Jewel.

  4. After-Sales Services – TJ Care Packages:

    • Basic Care Package:

      • Valid for 24 months from the purchase date.

      • Includes one-time coverage for resizing, polishing, or plating services during the 24-month period. After the first use, any additional resizing or services will incur a service fee.

    • Lifetime Care Package:

      • Provides lifetime coverage for resizing, polishing, and plating services, subject to normal wear and tear.

      • Limited to 3 instances of resizing, polishing, or plating services for the lifetime of the product.

      • The Lifetime Care Package covers reasonable changes in ring size and shape as a result of normal usage.

      • Exclusions: Does not cover extensive alterations, changes in design, resizing more than two sizes at a time, or damage resulting from misuse, alterations by third parties, or failure to follow care instructions.


4. ORDER ACCEPTANCE AND PRICING

Orders are subject to availability and acceptance by Tailored Jewel. We reserve the right to refuse or cancel any order for any reason, including but not limited to pricing discrepancies, issues with stock, or potential fraud. If an order is canceled due to mispricing, we may, at our discretion, contact you for further instructions or cancel the order and notify you of such cancellation.

5. TRADEMARKS AND COPYRIGHTS

All content and intellectual property rights on the Site, including logos, designs, images, and custom jewelry designs, are owned by Tailored Jewel. Unauthorized use of Tailored Jewel’s intellectual property is prohibited. Custom designs submitted by customers remain Tailored Jewel’s property, with customers retaining ownership of their original design concepts but granting us a perpetual, royalty-free license to use, modify, or display the design for promotional and marketing purposes.


6. JURISDICTION AND APPLICABLE LAW


7. ARBITRATION

Any disputes that cannot be resolved amicably will be settled through binding arbitration in Malaysia (for Malaysian customers) or Singapore (for Singaporean customers), governed by local law. The arbitration shall be conducted in English and shall be final and binding.


8. REFUND AND RETURN POLICY

  1. Custom Jewelry (Bespoke and Personalized Items):
    Custom-made jewelry, including items with personalized engravings or bespoke designs, are non-returnable unless defective. If the item is defective, Tailored Jewel will either repair or replace the item, or offer a partial refund depending on the item’s condition.

  2. Non-Custom Jewelry:
    Non-custom items may be returned within 14 days from receipt, provided they are in unused, resalable condition. The customer is responsible for return shipping costs, unless the item is defective or damaged. Once the return is verified, a full refund will be issued (excluding shipping costs).

  3. Faulty or Damaged Goods:
    If you receive a faulty or damaged item, please contact customer service within 7 days. Tailored Jewel will repair or replace the defective item at no additional cost.


9. DELIVERY AND PERFORMANCE

  1. Delivery Times:
    Delivery times are approximate and are subject to the complexity of custom orders. All deliveries are fully insured for peace of mind.

  2. Failure to Deliver:
    If Tailored Jewel fails to deliver within the agreed timeframe, customers may cancel the order within 14 days and request a refund (excluding shipping costs).


10. FORCE MAJEURE

Tailored Jewel shall not be liable for any failure to perform due to causes beyond our reasonable control, such as natural disasters, shipping delays, or government regulations. This includes circumstances like strikes, lockouts, or interruptions in supply chains that may affect delivery times.


11. PAYMENT TERMS AND METHODS

Tailored Jewel accepts various payment methods, including credit cards, debit cards, and bank transfers. All payments are processed securely, and prices are final at checkout. Customers should note that foreign exchange fees and bank charges may apply for international payments.


12. LIABILITY AND LIMITATION

  1. Tailored Jewel’s Liability:
    Tailored Jewel’s liability is limited to the purchase price of the product in question. We are not liable for any indirect or consequential losses, including loss of profits, goodwill, or damage to products after they are delivered.

  2. Defective Products:
    Tailored Jewel will repair or replace defective products at no cost to the customer within the warranty period. The maximum liability for defective products is limited to the purchase price of the product.


13. TERMINATION

Tailored Jewel reserves the right to terminate or suspend access to the Site for any violation of these Terms or failure to make payment. Upon termination, customers must cease using the Site, and we reserve the right to revoke access to any accounts.


14. GENERAL TERMS

  1. Amendment of Terms:
    Tailored Jewel reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on the Site, and your continued use of the Site constitutes acceptance of those changes.

  2. Severability:
    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

  3. No Waiver:
    Failure by Tailored Jewel to enforce any provision of these Terms does not waive our right to enforce such provision in the future.

  4. Third-Party Rights:
    No third party shall have the right to enforce any part of these Terms unless explicitly stated.
